ข้อตกลงสำคัญที่เอื้อประโยชน์ต่อไทย

ข้อตกลงสำคัญนี้คือ “บันทึกความเข้าใจระหว่างรัฐบาลแห่งราชอาณาจักรกัมพูชากับรัฐบาลแห่งราชอาณาจักรไทยในเรื่องการสำรวจและปักปันเขตแดนบนแผ่นดิน (Memorandum of Understanding between the Government of the Kingdom of Cambodia and the Kingdom of Thailand on the Survey and Demarcation of Land Boundary )” ซึ่งมีการลงนามกันที่กรุงพนมเปญ เมื่อ 8 มิถุนายน พ.ศ. 2543 (ค.ศ. 1990) โดยกล่าวว่า “The survey and demarcation of land boundary between the Kingdom of Cambodia and the Kingdom of Thailand shall be jointly conducted in accordance with the following documents” โดยจะเป็นการดำเนินงานร่วมกันให้สอดคล้องกับหลักฐานดังต่อไปนี้.
1. สนธิสัญญาสยาม-ฝรั่งเศส เกี่ยวกับเขตแดน...ลงวันที่ 13 กุมภาพันธ์ 1904 ณ กรุงปารีส(Convention between France and Siam modifying the Stipulations of the Treaty of the 3 October 1893, regarding Territorial Boundaries and other Arrangements signed at Paris, 13 February 1904)
2. ข้อตกลงสยาม-ฝรั่งเศส ลงวันที่ 23 มีนาคม 1907 ณ กรุงเทพฯ (Treaty between His Majesty the King of Siam and President of the French Republic, signed at Bangkok, 23 March 1907)
3. แผนที่ปักปันฯ ซึ่งแนบท้ายสนธิสัญญาปี 1904 และข้อตกลงปี 1907 (Maps which are the results of demarcation works of the Franco-Siamese Commissions of Delimitation set up under the Convention of 1904 and the Treaty of 1907 between France and Siam, and other documents relating to the application of the Convention of 1904 and the Treaty of 1907 between France and Siam).
โดยทั่วไปหลักฐานและเอกสารต่างๆ จะเรียงลำดับความสำคัญตามหัวข้อ สิ่งสำคัญที่สุดคือข้อ 1, รองลงไปคือข้อ 2 และความสำคัญลำดับสุดท้ายคือข้อ 3 ซึ่งก็หมายความว่า “ตั้งแต่ปี พ.ศ. 2543 จวบจนปัจจุบัน กัมพูชาได้เข้าใจ และเห็นพ้องว่าการสำรวจเพื่อปักปันเขตแดนระหว่างไทย-กัมพูชานั้น จะยึดถือสนธิสัญญาปี 1904 เป็นหลักเกณฑ์ในการปฏิบัติ” ด้วยเหตุนี้ ไทยเราก็สามารถที่จะเผชิญหน้า โดยยึดหลักการของบันทึกความเข้าใจปีพ.ศ. 2543 เพื่อให้มีการสำรวจเพื่อปักปันเขตแดนกันใหม่ตามสนธิสัญญาปี 1904 ปัญหาต่างๆ ก็จะได้รับการแก้ไขอย่างสมบูรณ์
